Privacy Disclaimer and Data Handling Addendum

This Privacy Disclaimer ("Addendum") forms an integral part of the Terms and Conditions ("T&C") governing the use of Recrewty.com (the "Platform") and applies to all Subscribers (account owners) accessing candidate data through the Platform.

1. Sensitive Nature of Data

The Subscriber acknowledges that the Platform processes and makes available sensitive personal data, including but not limited to the results of assessments, psychometric evaluations, aptitude tests, and potential analyses (the "Candidate Data"). Such data is confidential and subject to data protection obligations under applicable privacy laws.

2. Responsibilities of Recrewty (Platform Management)

Recrewty undertakes to implement and maintain appropriate technical and organizational measures to safeguard the security, integrity, and confidentiality of Candidate Data stored within its IT systems. This includes, but is not limited to, encryption, secure hosting, password protection, and access controls designed to prevent unauthorized access, cyberattacks, or data loss.

3. Responsibilities of the Subscriber (Account Owner)

The Subscriber is solely responsible for:

  • (a) Maintaining the confidentiality and security of Candidate Data once accessed through the Platform, including when such data is displayed onscreen, downloaded, or printed;
  • (b) Taking all reasonable and necessary measures to prevent unauthorized access to Candidate Data, including but not limited to securing physical and electronic media, limiting internal access to authorized personnel, and applying sound data handling practices;
  • (c) Recognizing that data breaches may occur through intentional disclosure (e.g., showing or distributing data to unauthorized third parties) or negligent acts or omissions (e.g., leaving printed materials unsecured, failing to log out of devices, or not preventing unauthorized viewing of screens).

4. Permitted Use and Authorized Access

Candidate Data shall be used solely for the legitimate and agreed-upon purpose of assessing candidates in the context of recruitment, selection, evaluation, or other forms of personnel assessment. Without the explicit and written consent of the candidate, the Subscriber shall not: Use Candidate Data for any other purpose; Share Candidate Data with any third party or unrelated internal departments. Authorized persons with access to Candidate Data are strictly limited to:

  • (a) The Subscriber (account owner);
  • (b) Employees or representatives of the Subscriber's organization who are directly and necessarily involved in assessment-based decision-making (e.g., members of an evaluation board, top managers responsible for selection decisions);
  • (c) The Candidate themselves, upon formal request for access to their own data.

5. Liability and Breach

The Subscriber acknowledges and accepts full responsibility for any unauthorized disclosure or misuse of Candidate Data arising from its own actions, omissions, or internal practices. Recrewty shall not be held liable for any breach or data leakage occurring after Candidate Data has been accessed or retrieved by the Subscriber.

The Subscriber agrees to respect the rights of candidates under applicable privacy laws, including but not limited to the rights of access, correction, and, where applicable, deletion of personal data, as defined in the Platform's Privacy Policy.
